Terms Of Service (TOS)

Data Center Guatemala utilizes FraudRecord to screen new orders for previous fraudulent activity and report existing clients who violate our Terms of Service. In case of a violation, you may be reported to FraudRecord for misbehaviour using one-way hashed information.

User Content

You may be able to upload, store, publish, display and distribute information, text, photos and other content on or through the Services.

DataCenterGuatemala exercises no control over, and accepts no responsibility for, User Content or the content of any information passing through DataCenterGuatemala's computers, network hubs and points of presence or the Internet. DataCenterGuatemala does not monitor User Content. However, you acknowledge and agree that DataCenterGuatemala may, but is not obligated to, immediately take any corrective action in DataCenterGuatemala’s sole discretion, including without limitation removal of all or a portion of the User Content or User Websites, and suspend or terminate any and all Services without refund if you violate the terms of this Agreement. You hereby agree that DataCenterGuatemala shall have no liability due to any corrective action that DataCenterGuatemala may take.

Prohibited Uses

Infringement of Intellectual Property Rights.

Use of the Services to infringe upon another party’s intellectual property rights is prohibited. This includes, but is not limited to, the unauthorized copying or distribution of movies, music, books, photographs, software/warez, or any other copyrighted work.

Selling or offering to sell any counterfeit merchandise will result in the immediate termination of your account. Any account found to be infringing on the intellectual property rights of others will be expeditiously removed or access to the material will be disabled.

Any account found to be in repeated violation of this prohibition will be suspended or terminated.

You may not use an account as a backup/storage device with the exception of our specific online backup service


Unacceptable material on our servers include without limitation:
Topsites
IRC Scripts/Bots
IRCD (irc servers)
Image Hosting Scripts (similar to Photobucket or Tinypic)
AutoSurf/PTC/PTS/PPC sites
IP Scanners
Bruteforce Programs/Scripts/Applications
Mail Bombers/Spam Scripts
Banner-Ad services (commercial banner ad rotation)
File Dump/Mirror Scripts (similar to rapidshare)
Commercial Audio Streaming (more than one or two streams)
Escrow/Bank Debentures
High-Yield Interest Programs (HYIP) or Related Sites
Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme)
Sale of any controlled substance without prior proof of appropriate permit(s)
Prime Banks Programs
Lottery/Gambling Sites
MUDs/RPGs/PBBGs
Hacker focused sites/archives/programs
Sites promoting illegal activities
Forums and/or websites that distribute or link to warez/pirated/illegal content
Bank Debentures/Bank Debenture Trading Programs
Fraudulent Sites (Including, but not limited to sites listed at aa419.org & escrow-fraud.com)
Mailer Pro
Push button mail scripts
Broadcast or Streaming of Live Sporting Events (UFC, NASCAR, FIFA, NFL, MLB, NBA, WWE, WWF, etc)
Tell A Friend Scripts
Anonymous or Bulk SMS Gateways
Bitcoin Miners
PayDay Loan Sites (including any site related to PayDay loans, PayDay loan affiliate progams, etc)
Child Pornography Prohibited.

We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene, threatening, illegal, or violates our Terms of Service or this AUP in any manner may be removed from our servers (or otherwise disabled), with or without notice.


Resource Usage Limits
a) exceed a 15 minute load average greater than two (2) times the amount of CPU cores given.
b) run public IRCd's or malicious bots.
c) run any type of BitTorrent client or tracker that links to or downloads illegal content.
d) use I/O intensive applications which adversely affect normal server operations.

DataCenterGuatemala no supervisa el Contenido del Usuario. Sin embargo, usted reconoce y acepta que DataCenterGuatemala puede, pero no está obligado a ello, tomar de inmediato las medidas correctivas a la sola discreción de DataCenterGuatemala, incluyendo sin retirar la limitación de la totalidad o una parte del Contenido del usuario o las páginas web de los usuarios, y suspender o cancelar cualquier y todos los Servicios sin reembolso si usted viola los términos de este Acuerdo.

Por el presente acuerdo en que DataCenterGuatemala no tendrá ninguna responsabilidad por cualquier acción correctiva que DataCenterGuatemala puede tomar.

Usos prohibidos

Infracción de los Derechos de Propiedad Intelectual.

Se prohíbe el uso de los Servicios para infringir los derechos de propiedad intelectual de terceros. Esto incluye, pero no está limitado a, la copia o distribución de películas, música, libros, fotografías, software / warez, o cualquier otro trabajo con derechos de autor sin autorización.

Vender u ofrecer la venta de cualquier mercancía falsificada dará lugar a la terminación inmediata de su cuenta. Cualquier cuenta descubierta que infringen los derechos de propiedad intelectual de los demás será removida o desactivará el acceso al material.

Cualquier cuenta que se encuentre en violación repetida de esta prohibición será suspendida o cancelada.

Nos reservamos el derecho de rechazar prestar el servicio a cualquier persona. Cualquier material que, a nuestro juicio, es obsceno, amenazante, ilegal, o que viole nuestros términos de servicio o esta Política de uso aceptable.

Límites de uso de recursos
a) superar un promedio de carga 15 minutos superior a dos (2) veces la cantidad de núcleos de CPU determinado.
b) ejecutar IRCd o bots maliciosos.
c) ejecutar cualquier tipo de cliente de BitTorrent o rastreador que enlaza con o descargue contenidos ilegales.
d) el uso de E / S de las aplicaciones intensivas que afectan negativamente a las operaciones normales del servidor.
